General data protection and usage guidelines for the Moodle learning platform at the Weihenstephan - Triesdorf University of Applied Sciences

General

The data protection and usage guidelines are based on the Bavarian Data Protection Act (BayDSG) and on the usage guidelines for information processing systems of the HSWT. Acceptance of the data protection and usage guidelines is a prerequisite for using the Moodle learning platform at Weihenstephan - Triesdorf University of Applied Sciences. All users - students, lecturers and staff of the HSWT, external users - must agree to the General Data Protection and Usage Guidelines before they can use Moodle.

The Moodle learning platform for continuing education and internationalisation at Weihenstephan-Triesdorf University of Applied Sciences provides an online service for lecturers, students, staff, external course participants and research partners of Weihenstephan-Triesdorf University of Applied Sciences.

The Moodle course rooms can be used to provide scripts, distribute materials and for organisational, communicative and collaborative purposes.

Moodle course rooms are requested by emailing helpdesk@hswt.de. External course participants are activated by the Centre for Studies and Continuing Education. The import of users from the central authentication system of Weihenstephan-Triesdorf University of Applied Sciences into individual Moodle course rooms as well as the final removal of Moodle course rooms is requested via helpdesk@hswt.de.

The Centre for Studies and Continuing Education at Weihenstephan-Triesdorf University of Applied Sciences reserves the right to delete Moodle course rooms after 2 years of passivity.

The Moodle learning platform for continuing education and internationalisation at Weihenstephan-Triesdorf University of Applied Sciences can be used by all members of the university and is available to all students, lecturers and staff and external course participants. For the duration of time-limited projects, cooperations or similar, external participants or lecturers of the university can be granted a temporary manual access authorisation via the Centre for Studies and Continuing Education with the approval of the person responsible for the project or upon application by the person responsible for the project.

The right to use the Moodle learning platform for continuing education and internationalisation at Weihenstephan-Triesdorf University of Applied Sciences ends automatically upon exmatriculation (students), termination of employment at Weihenstephan-Triesdorf University of Applied Sciences (lecturers, staff) or upon expiry of the projects and courses (external users) or the teaching assignment (lecturers). The following regulations apply to all user groups.

Data protection

The Moodle learning platform for continuing education and internationalisation at Weihenstephan-Triesdorf University of Applied Sciences is connected to the central authentication system of Weihenstephan-Triesdorf University of Applied Sciences. It is possible to self-register directly on the Moodle landing page. Registered users are activated by the Centre for Studies and Continuing Education or created locally in the system. University members (students, lecturers, staff) can log on to the system using their user ID and password.

Type of data

The system collects, stores and processes the following necessary inventory, user and connection data of a participant in Moodle:

  • Master registration data (login name, password, first and last name, email address).
  • Voluntary personal data (e.g. profile picture, hobbies, etc.)
  • Course participation
  • User-generated data in the form of contributions to forums, chats, wikis, etc.

The master data stored in the university's central authentication system cannot be changed by the users themselves. Changes to the voluntarily entered profile information can be made by the users themselves. Furthermore, it is possible to make the email address invisible to other students in the profile settings. Please note that your e-mail address will always be visible to course instructors and administrators regardless of the settings you have made.

Depending on the role of the other users (guest, participant, lecturer, manager, administrator) the following of your profile details will be visible to other users:

  • Registered users of the platform: first and last name, photo if applicable.
  • Participants in a course: country, university, role in the course, in which course rooms they are registered, group affiliation as well as other voluntary profile information.
  • Course instructors: additional e-mail address and last access to the course
  • Administrators (technical administration of the Moodle platform, data and web server): Access to all personal data stored in the system.

Access to personal data by non-registered participants is not possible.

All users are prohibited from disclosing to third parties the personal data of other users to which they have access, in particular their names and e-mail addresses, unless the persons concerned have given their express permission to do so.

Log data

The system logs accesses and page views made by users in Moodle in the form of log data including time, full name and information on the type of action performed. This data can be viewed by the administrators and is used for the technical support of the system. Abbreviated, summary evaluations are also visible to course administrators, but these do not reveal who used which element.

After students have left the student relationship, external course participants have left the course or project, lecturers and staff have left the employment relationship with Weihenstephan - Triesdorf University of Applied Sciences, this personal data is anonymised.

Copyright

All files and content that you upload to or leave on the Moodle website are subject to the applicable copyright laws. The copyright law of the Federal Republic of Germany is the part of the legal system that protects the author's right to his or her works. It is your responsibility to ensure that you have the necessary permission to reproduce and publish any academic work, music, images, videos etc. that are not your own. You acknowledge and respect the copyright of all information and materials contributed to the Moodle learning management system by members or external parties.

Moreover, the responsibility to apply copyright correctly lies with each teacher him/herself. The person responsible for the course room must be informed if there is any evidence of infringement. Persons who upload material to Moodle on behalf of a teacher must be assigned the role of "editor" by the teacher. This role assignment shows that the person in question is acting on behalf of the teacher and is not responsible for the content of the upload. The responsibility always lies with the person responsible for the course room.

Duties of the users

Upon registration, users are granted a simple, non-transferable right to use the Virtual Campus of Weihenstephan-Triesdorf University of Applied Sciences. All users are obliged to treat the data of other participants accessible to them as strictly confidential and, as a matter of principle, not to pass this data on to third parties without the consent of the person concerned. The Virtual Campus serves exclusively to support the creation and implementation of courses and projects at Weihenstephan-Triesdorf University of Applied Sciences as well as with and at the partners of the university/partner universities and for internal communication between learners and teachers. Any other use requires the agreement of the Centre for Studies and Continuing Education. Any other use of the platform, e.g. for other private and/or commercial purposes, is not permitted. All users are obliged to comply with the legal provisions, in particular the provisions of copyright law and data protection. If users set links to external websites, they must check in advance that the external websites thus linked do not have any illegal content. As a matter of principle, all users on the learning platform are prohibited from:

  • change, delete, suppress, render unusable and/or use data other than for its intended purpose without authorisation.
  • in particular, to disseminate material of unconstitutional organisations or their ideas.
  • to make hurtful, insulting or defamatory statements about others.
  • to post, store or display offensive, unlawful or immoral material.
  • damage the reputation of Weihenstephan-Triesdorf University of Applied Sciences.

Any kind of abuse of behaviour by a user of the Moodle learning platform of Weihenstephan-Triesdorf University of Applied Sciences must be reported immediately to the Centre for Studies and Continuing Education.

Changes and availability of the learning platform

The Centre for Studies and Continuing Education at Weihenstephan-Triesdorf University of Applied Sciences reserves the right to change or remove parts or certain functions of the Virtual Campus at any time. Access to the Moodle learning platform may be temporarily restricted for maintenance purposes. The Centre for Studies and Continuing Education will endeavour to keep downtimes as short as possible.

Liability

The Centre for Studies and Continuing Education of Weihenstephan-Triesdorf University of Applied Sciences, as the operator of the Virtual Campus, is in principle not liable for grossly negligent or intentional breaches of duty. This also applies in particular to damage caused to users of the Virtual Campus by downloading materials or software and other transactions on the user's technical equipment. Users themselves are responsible for ensuring that their computers are adequately protected against damaging files. In the event of culpable violation by the user of legal obligations or the obligations regulated in these terms of use, the user shall be liable in accordance with the statutory provisions.

The backup and storage of data is also the responsibility of each user. No liability is accepted for lost data and any resulting damage.

The Centre for Studies and Continuing Education of the Weihenstephan-Triesdorf University of Applied Sciences accepts no liability for any infringement of the rights of third parties.

Other regulations

The usage guidelines for information processing systems of the Weihenstephan-Triesdorf University of Applied Sciences, as amended from time to time, continue to apply.

Changes to these regulations

If changes are made to the terms of use of the Moodle learning platform, users will be informed of the new version in an appropriate manner (e.g. by giving their consent when logging on to the Moodle learning platform). If the user does not agree to the change, the possibility of using the Moodle learning platform shall end when the new, amended version comes into force.

Acceptance of the Terms of Use

I have read and understood the Privacy Policy and the Terms of Use and the information on disclaimers. I acknowledge the terms of use and the disclaimer.

I am aware that mandatory personal data is processed for participation in the Moodle learning platform. I agree to the processing of the data I have entered in my "personal profile" and the contributions I have published by name as well as to the use of the files I have made available within the framework of the Moodle learning platform.

I am aware that this consent can be revoked at any time by sending an e-mail via the helpdesk. In this case, I will no longer be able to use Moodle and my data will be deleted.
